CONAMA que aprovaram Resolução que permitirá altos limites de emissão
de poluição

representantes no Conama (Bicuda Ecológica - região sudeste; OCA BRASIL

está divulgando a nota que segue abaixo criticando a postura dos
conselheiros do Conselho Nacional do Meio Ambiente por terem aprovado
uma resolução que permitirá altos limites de emissão de poluição
atmosférica para novas fontes fixas, tais como combustão de óleo
combustível, gas natural, bagaço de cana, refinarias de petróleo,
fabricação de celulose, fusão secundária de chumbo, aluminio primário,
fornos de fusão de vidro, cimenteiras, produção de fertilizantes,

A ACPO representa a
Sociedade Civil brasileira em diversas redes internacionais contra a
poluição química, tal como IPEN - International POPs Elimination
Network, GAIA - Global Anti-Incineration Alliance, e HCWH - Health Care
Without Harm.
Em parceria com a ACPO, a
APROMAC, ong conselheira do CONAMA, apresentou um ofício alertando os
conselheiros sobre a recente divulgação do relatório da Organização
Mundial da Saúde que solicita aos governos do mundo todo que diminuam
seus limites permitidos pois já existem dados suficientes que mostram
que os limites atualmente em vigor são muito altos, e estão fortemente
relacionados com a incidência de diversas doenças em seres humanos. No
ofício, as ONGs solicitaram que a proposta de resolução não fosse
discutida nem votada antes de ser revisada à luz deste importante e
recente relatório. Além disso, as ONGs advertiram que a proposta não
permite o controle social das comunidades que serão afetadas por esses
novos índices, mas delega aos órgãos ambientais fiscalizadores o poder
de fixar limites sem qualquer participação democrática das populações a
serem afetadas. Também advertiram que o Brasil é signatário da
Convenção de Estocolmo sobre Poluentes Orgânicos Persistentes, e que
essa Resolução é um retrocesso no processo de implementação da
Convenção no país, prevista para começar no próximo ano.
Ademais, as ONGs lembraram que os índices propostos na Resolução estão
muito acima dos índices já em vigor no Brasil, e solicitaram que fossem
esclarecidas as fontes e referências técnicas e científicas que deram
fundamentação para os limites ali propostos. Infelizmente essa
explicação não foi dada pelo presidente da Câmara Técnica de Controle e
Qualidade Ambiental, Sr. Cláudio Alonso, que é funcionário da
CETESB/SP, órgão de meio ambiente de São Paulo, principal defensor da

Entretanto, a Resolução foi aprovada sem que as solicitações das ONGs
tivessem sido atendidas. Após a aprovação, a APROMAC e mais 9 ONGs
conselheiras do CONAMA assinaram um requerimento de urgência
solicitando explicações e quais medidas serão tomadas pelos Ministérios
da Saúde, Meio Ambiente e Trabalho sobre as conseqüências da
implementação dessa Resolução em relação à estrutura técnica e humana
deficiente dos órgãos estaduais e municipais de meio ambiente, da
estrutura de atendimento à saúde pública nos estados e municípios, e
dos efeitos sobre a saúde dos trabalhadores dessas plantas em todo o
Brasil.

Retrocesso na Qualidade
Ambiental
Governo Lula não fica apenas no discurso e avança
rapidamente com a sua infeliz política de "destravamento" ambiental -
agora engessando os Conselhos de Meio Ambiente.
Depois das infelizes declarações do Presidente
Lula, que afirmou ser preciso retirar entraves ambientais para
desenvolver o País - qualificando os ambientalistas, os povos
indígenas, os quilombolas, o Ministério Público e o Tribunal de Contas
da União como esses entraves, o representante do Governo do Estado de
São Paulo no CONAMA, Sr. Cláudio Alonso, engrossou o discurso e repetiu
calorosamente, durante reunião do CONAMA realizada dias 29 e 30 de
novembro, que "o meio ambiente não pode ser entrave do
desenvolvimento".
Revestido desta lógica, o CONAMA seguiu a risca as
determinações do Presidente da República e aprovou a Resolução
denominada "Fontes Fixas", que desconsidera as novas recomendações da
Organização Mundial de Saúde, que reduziu severamente os limites
máximos aceitáveis de poluentes no ar para garantir a saúde dos seres
humanos.
A bancada ambientalista solicitou o adiamento da
votação para possibilitar a adequação da resolução aos novos padrões de
qualidade, porém a proposta foi rejeitada pelo Sr. Cláudio Alonso,
presidente da câmara técnica responsável. A Resolução aprovada, além de
garantir que as fontes poluidoras mantenham os limites atuais de
emissão, que tem saturado ambientalmente as cidades brasileiras, tirou
dos Conselhos Estaduais de Meio Ambiente o poder de opinar sobre a
matéria, já que a partir da publicação da resolução os próprios órgãos
estaduais do meio ambiente, que atualmente licenciam e fiscalizam ao
mesmo tempo, agora têm o poder de regular a legislação, pois a
Resolução autoriza os órgãos estaduais ambientais não apenas a
reduzirem, como já é previsto na legislação, mas a aumentarem os
limites de emissão a seu critério.
A situação criada, além de equivoco administrativo,
tirou dos Conselhos o direito de serem consultados sobre questões como:
limites de emissão, capacidade de suporte de poluentes em bacias aéreas
e o destino das regiões saturadas. A resolução engessou os Conselhos de
Meio Ambiente para não poderem mais discutir sobre isso, pois agora o
órgão ambiental não tem a obrigação de consultá-los sobre a matéria.
Depois da vitória em plenário, os membros do CONAMA
foram festejar junto com os empresários em jantar de gala oferecido
pela FIESP em um badalado clube de golfe de Brasília, 25 anos de
CONAMA.
Parte da bancada ambientalista, depois de assistir
o 'tratoraço' acionado durante a reunião do CONAMA, ficou indignada e
recusou o convite para participar da confraternizaçao oferecida pelos
industriais, declarando que não tinham nada a comemorar.

fighting against chemical pollution denounce press release on
Resolution of the Brazilian National Environment Council (CONAMA).

CONAMA’s
Councilors approved a Resolution that will allow higher levels of
pollution emission.

Brazil- ACPO,
Anti Pollutants Association (POPs), supported by the environmentalist
NGOs representatives at CONAMA (Bicuda Ecológica – southeast region;
OCA BRASIL – center-west region; and APROMAC – south region) is
circulating the press release seen below criticizing the posture of the
CONAMA’s councilors who approved a resolution which will allow the
emission of high levels of atmospheric pollution for new fixed sources
(new plants), such as combustion of fuel, natural gas, crushed
sugarcane, oil refineries, cellulose plants, lead smelting, primary
aluminum, glass fusion furnaces, cement kilns, fertilizers production,

is a member of several international networks working against chemical
pollution such as IPEN - International POPs Elimination Network, GAIA -
Global Anti-Incineration Alliance and HCWH - Health Care Without Harm.
Before
voting, APROMAC, a NGO councilor to CONAMA, in partnership with ACPO,
delivered a letter warning the councilors about the recent report of
the WHO that requires the world governments to reduce their allowed
limits since there is enough data showing that the current allowed
limits are very high, and they are strongly linked to a lot of diseases
in human beings. In the letter, the NGOs asked
that the resolution proposal should not be discussed or voted before
being reviewed under the light of this important report. Besides,
the NGOs explained that the proposal did not allow an effective social
control by the communities which will be affected by these new limits,
by delegating to the inspecting environmental agencies the power to set
forth the limits without consulting the populations. The NGOs also reminded
that Brazil is
a signatory of the Stockholm Convention on Persistent Organic
Pollutants, and that this resolution is a huge set back in terms of the
implementation process of the Convention in the country, foreseen to
begin in the 2007.
Furthermore, the NGOs observed that the limits proposed in the
Resolution are much above the limits in force in Brazil, and asked
clarification about the technical sources and references on which the
limits now proposed were based. The requested
explanation was not given by the chair of the Technical Chamber of
Environment Control and Quality, Cláudio Alonso, who is also an officer
of the State Environment Agency (CETESB/SP) of the State of Sao Paulo,
and enthusiastically supportive of the proposal. See

However, the resolution was approved without first answering the NGOs
request. After
approval, APROMAC and other 9 NGOs councilors of CONAMA signed an
urgent petition requesting explanations and which measures will be
taken by the Ministries of Health, Environment and Labor to face the
consequences of the implementation of such resolution. The
document highlights the deficient technical and human structure of the
state and municipal environment agencies, the poor public health
attendance structure in the states and municipalities, and questions
the effects on the workers’ health at these plants in the whole
national territory and which measures will be taken by the authorities.

in Environmental Quality
President
Lula does not stop at words, he advances very quickly his unfortunate
policy of environmental “unlocking” by restricting the action of the
Environment Councils.
After
his statements, where he affirmed that is necessary to unlock the
environment impediments to develop the country – qualifying
environmentalists, indigenous and quilombo (former African slaves
communities) people, the Public Prosecutors and the Union Financial
Court as being the real impediments, the representative of the State of
Sao Paulo Government toCONAMA,
Cláudio Alonso, supported said discourse and repeated enthusiastically,
during the CONAMA’s ordinary meeting held in November 29th and 30th, that “the
environment cannot be an impediment to development”.
Invested
with this logic, CONAMA followed the determinations of the Brazilian
President and approved the resolution named “Fixed Sources” which
disregards the new WHO recommendations to reduce drastically the
maximum limits acceptable for air pollutants, which aim at preserving
and ensuring the human beings’ health.
The
environmentalist bloc requested that the vote be postponed to allow for
an adaptation of the resolution to the new quality standards, but it
was rejected by Claudio Alonso, chair of the Technical Chamber in charge.
The approved resolution, besides allowing the pollutant sources to keep
the current emission limits, which has poisoned the air of most
Brazilian cities, deprived the state and city environment councils the
power to decide on the matter, since as from the publication of the
resolution, only the state and city environment agencies, which are
concurrently license grantors and inspectors, have the power to
regulate the legislation not only to reduce the limits, but to increase
them at their discretion.
This
situation, besides being administratively ambiguous, also deprived the
Councils the right to be consulted on matters such as emission limits,
air basin pollution support capacity and the destiny of the saturated
areas. The resolution restricted the Environment councils in such a
manner that they cannot discuss the matter any more, since now the
environment agency has not obligation to consult them thereon.
After the
“victory” attained at the ordinary meeting, the members of CONAMA went
together to celebrate the 25th
anniversary of CONAMA with the entrepreneurs at a festive dinner
offered by the Industries Federation of the State of Sao Paulo at a
famous golf club of Brasilia.
Part
of the environmentalist bloc after witnessing the serious coup,
indignant with what happened during the CONAMAs meeting, refused the
invitation stating that they had anything to commemorate.
